Welcome to Swing Jam, operated by Chiwu TECH ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Swing Jam platform, including our mobile applications, websites, and related services (collectively, the "Services").
By creating an account or using Swing Jam, you agree to these Terms. If you do not agree, please do not use our Services.
1. Eligibility
- You must be at least 13 years old (or the minimum legal age in your country) to use Swing Jam.
- If you are under 18, you may use Swing Jam only with parental/guardian consent.
- By registering, you represent that the information you provide is accurate and truthful.
2. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to notify us immediately of any unauthorized use of your account.
- We may suspend or terminate accounts that violate these Terms.
3. Services Provided
Swing Jam is a platform that allows:
- Users to browse, save, and participate in swing dance events and activities.
- Organizers to publish event and course information, including free and paid activities.
- Community Co-Creation where users may propose event updates, contribute content, or tag participants.
- Swing Passport and Jam Points features that record participation, achievements, and contributions.
- Payment & Subscription Services that allow organizers to sell training sessions and allow users to subscribe for premium features.
4. Content and Intellectual Property
- Users and organizers retain ownership of the content they post (e.g., event details, photos, text).
- By posting, you grant Swing Jam a worldwide, royalty-free, non-exclusive license to use, display, and distribute your content in connection with the Services.
- You must have the necessary rights to any content you upload. Do not post content that infringes on others' rights.
5. Community Rules
When using Swing Jam, you agree NOT to:
- Post unlawful, abusive, discriminatory, or misleading content.
- Impersonate others or misrepresent your identity.
- Collect or misuse other users' personal information.
- Interfere with the operation or security of the Services.
Violation of these rules may result in suspension or termination of your account.
6. Payments & Commissions
- Organizers may sell paid courses or event tickets through Swing Jam.
- Swing Jam charges a 1% commission on each transaction.
- Payments are processed through third-party payment providers. By using paid features, you agree to their terms and policies.
- All fees are non-refundable except where required by law.
7. Subscriptions & Jam Points
- Swing Jam may offer premium subscription plans (monthly, quarterly, yearly).
- Subscriptions automatically renew unless canceled before the renewal date.
- Jam Points are credits earned by contributions or purchases. They may be redeemed for subscriptions or rewards but have no cash value and cannot be transferred or refunded.
8. Privacy
- We collect and use your personal data according to our Privacy Policy.
- By using Swing Jam, you consent to the processing of your information in accordance with applicable laws.
9. Disclaimers
- Swing Jam provides event and community information for cultural and entertainment purposes.
- We do not guarantee the accuracy, completeness, or availability of events posted by organizers.
- We are not responsible for third-party services, venues, or activities. Participation is at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law:
- Swing Jam and Chiwu TECH shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.
- Our total liability for any claims related to the Services shall not exceed the amount you paid us in the last 12 months.
11. Termination
- You may stop using Swing Jam at any time.
- We may suspend or terminate your account if you violate these Terms or use the Services unlawfully.
12. Governing Law
